1. Acceptance of Terms

By accessing or using Yoomento's website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services. These Terms apply to all users, including guests, registered users, mentors, and coaches.

2. Description of Services

Yoomento provides a platform that facilitates:

  • Connection between users and volunteer or professional mentors
  • Connection between users and certified coaches
  • Free self-assessment tools, habit trackers, and screen detox guides
  • Screen dependency and digital wellness programs
  • Educational content and resources

Yoomento is a platform intermediary. We do not directly provide mentorship or coaching — we facilitate connections between users and independent mentors/coaches.

3. Not Medical or Therapeutic Services

Yoomento's services are not a substitute for professional medical, psychological, or mental health treatment. Mentors and coaches on Yoomento are not licensed therapists, psychiatrists, or medical professionals in the context of their Yoomento engagement.

If you are experiencing a mental health crisis, suicidal thoughts, or require urgent medical attention, please contact emergency services or a licensed mental health professional immediately.

4. User Accounts

You must be 16 years of age or older to create an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to your account.

5. User Conduct

You agree not to:

  • Use the platform for any illegal purpose
  • Harass, abuse, or threaten other users or mentors
  • Share false or misleading information in your profile or sessions
  • Attempt to circumvent the platform to conduct transactions outside Yoomento
  • Use the platform to advertise services outside of your Yoomento profile
  • Violate any applicable laws or regulations

YOOMENTO Refund & Cancellation Policy

At YOOMENTO, we strive to provide a reliable experience for both users and mentors/coaches. Because mentorship and coaching are scheduled professional services, the following policy applies to all bookings made through the platform.

6. Cancellation by the User

  • More than 24 hours before the scheduled session: Users may cancel and receive a full refund or reschedule at no additional charge.
  • Within 24 hours of the scheduled session: The booking becomes non-refundable. The mentor or coach will receive payment unless YOOMENTO determines, in its sole discretion, that extraordinary circumstances justify an exception.

7. No-Show by the User

If a user fails to attend the session or is more than 10 minutes late without prior communication, the session will be considered completed and no refund will be issued.

8. Cancellation or No-Show by the Mentor or Coach

If a mentor or coach cancels within 24 hours of the scheduled session or fails to attend, the user may receive a full refund or choose to reschedule. Repeated cancellations or no-shows may result in suspension or removal from the platform.

9. Session Completion Review Period

When a mentor or coach marks a session as completed, payment is not released immediately.

  • Provider earnings are held for a 48-hour review period.
  • During this period, users may report issues through YOOMENTO.
  • YOOMENTO may investigate reported issues and may temporarily hold, adjust, delay, or cancel a provider payout while the matter is reviewed.
  • If no issue is reported during the 48-hour review period, the provider's earnings will proceed through Stripe's payout schedule.

10. Refund Requests

Refund requests must be submitted within 48 hours after a session has been marked complete.

After the 48-hour review period expires, refund requests will generally not be approved except where required by law or in cases involving fraud, unauthorized transactions, or other exceptional circumstances as determined solely by YOOMENTO.

11. Completed Sessions

Once a session has been substantially completed, refunds will not be issued because a user:

  • Was dissatisfied with the advice or coaching style;
  • Did not achieve their desired outcome;
  • Changed their mind after the session; or
  • Failed to prepare for or participate meaningfully in the session.

Mentorship and coaching outcomes depend on many factors beyond the provider's control.

12. Technical Issues

If a session cannot be completed due to verified technical issues outside the control of both parties, YOOMENTO may, at its sole discretion, offer a replacement session, partial refund, or other appropriate resolution.

13. Chargebacks and Payment Disputes

Users agree to contact YOOMENTO before initiating a chargeback with their payment provider.

Because payment disputes and refund processing fees are charged to YOOMENTO, the platform reserves the right to investigate all disputes. Fraudulent, abusive, or repeated chargebacks may result in suspension or permanent termination of the user's account.

14. Provider Payout Protection

To protect users, providers, and the platform:

  • YOOMENTO may delay or place an administrative hold on any payout when there is a pending complaint, refund request, suspected fraud, unusual account activity, or elevated dispute risk.
  • For higher-value bookings or transactions identified as higher risk, YOOMENTO may extend the payout hold until the session has been verified and any concerns have been resolved.
  • Providers acknowledge that payouts may be delayed while investigations are conducted.

15. Provider Responsibility

If a refund, reversal, chargeback, or payment recovery results from a provider's misconduct, failure to deliver services, violation of YOOMENTO policies, fraud, or breach of these Terms, YOOMENTO reserves the right to recover the applicable amounts from future earnings or by any other lawful means.

16. Independent Contractor Status & Tax Responsibilities

All mentors, coaches, and service providers on YOOMENTO operate as independent contractors, not as employees, agents, partners, or representatives of YOOMENTO.

As independent contractors, service providers are solely and exclusively responsible for:

  • Determining, reporting, and paying all applicable local, state, national, and international income taxes, self-employment taxes, value-added taxes (VAT), goods and services taxes (GST), and any other taxes or levies arising from income earned through the YOOMENTO platform;
  • Obtaining any required tax identification numbers, registrations, or licences required by their applicable tax authority;
  • Maintaining accurate records of all earnings received through YOOMENTO for tax reporting purposes;
  • Complying with all applicable tax laws and regulations in their jurisdiction.

YOOMENTO bears no responsibility, liability, or obligation of any kind regarding a service provider's income taxes, self-employment taxes, VAT, GST, or any other tax obligations. YOOMENTO does not withhold taxes from provider earnings, does not provide tax advice, and does not file tax returns on behalf of any service provider.

Service providers acknowledge that it is their sole responsibility to seek independent tax or legal advice to understand and fulfil their tax obligations. YOOMENTO shall not be held liable for any tax penalties, interest, assessments, or other consequences arising from a service provider's failure to comply with applicable tax laws.

17. Final Authority

All refund requests, disputes, cancellations, payout holds, and payment decisions are made solely at the discretion of YOOMENTO.

YOOMENTO reserves the right to deny refunds, delay payouts, recover funds, suspend accounts, or take any other action reasonably necessary to protect the platform, its users, and its mentors/coaches from fraud, abuse, financial loss, or violations of these Terms.

By booking or providing services through YOOMENTO, all users and mentors/coaches acknowledge and agree to this Refund & Cancellation Policy.

18. Right of Setoff and Recovery of Amounts Owed

By using YOOMENTO as a mentor, coach, or service provider, you authorize YOOMENTO to recover any amounts owed to the platform arising from refunds, chargebacks, payment disputes, transaction reversals, penalties, fees, damages, fraud, misconduct, violations of YOOMENTO policies, or any other amounts for which you are responsible.

To the extent permitted by law, YOOMENTO may:

  • Deduct amounts owed from your current or future earnings, pending payouts, credits, or balances held through the platform;
  • Delay, suspend, or withhold payouts while investigating potential losses, disputes, or obligations;
  • Apply any available funds associated with your account toward outstanding amounts owed to YOOMENTO;
  • Seek reimbursement directly from you if available platform balances are insufficient to cover the amount owed.

If a refund, chargeback, dispute, reversal, or other financial loss occurs after a provider has received payment, and the loss is determined to be related to the provider's services, actions, omissions, failure to deliver the session, violation of platform rules, or other responsibility of the provider, the provider agrees to reimburse YOOMENTO for the applicable amount, including any associated processing fees, dispute fees, or administrative costs.

This right of setoff survives termination of your YOOMENTO account and remains effective until all outstanding obligations owed to YOOMENTO have been fully satisfied.

19. Mentor and Coach Conduct

Mentors and coaches who join the platform agree to: represent their qualifications accurately, maintain appropriate professional boundaries, not provide medical or therapeutic advice, respond to session requests in a timely manner, and adhere to Yoomento's community guidelines.

20. Intellectual Property

All content on Yoomento (including tools, assessments, articles, design, and code) is owned by Yoomento unless otherwise noted. You may not reproduce, distribute, or create derivative works without our explicit written permission.

21. Limitation of Liability

To the maximum extent permitted by law, Yoomento shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid to Yoomento in the 12 months preceding the claim.

22. Governing Law

These Terms are governed by the laws of the jurisdiction in which Yoomento is incorporated. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

23. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via email to registered users. Continued use of the platform after such changes constitutes acceptance of the new Terms.
